Animal Tracks Online, www.animal-tracks.com, Animal Tracks, and Archer New Media, Ltd. reserve the right to refuse advertising and advertising copy and to edit all submissions; and do not accept advertising or copy deemed to be misleading or inappropriate for publication. Where space is limited, advertising will be taken on a first-come, first-served basis.

All opinions and statements contained in advertising in Animal Tracks Online or in printed materials and/or directories are believed to be reputable, truthful and accurate. However, publication of opinions and statements in advertising does not imply either endorsement or recommendations of any product, service, or activity. Further, the opinions and statements contained in advertising on this site or in any printed materials derived from this site are those of the authors of such opinions and are not necessarily those of Animal Tracks Online or Archer New Media, Ltd., nor does Animal Tracks Online or Archer New Media, Ltd. assume any responsibility or liability for their accuracy or for errors, including without limitation, typographical errors, or omissions in Animal Tracks Online or derived printed materials from the site. Liability for the contents of all advertising and for any claims that may arise therefrom, is the responsibility of advertisers and their agencies who place the ads. All transactions between advertisers, advertising agencies, organizations, and readers are between the parties involved.

Animal Tracks Online and Archer New Media, Ltd. welcome but assume no liability for unsolicited advertising materials. All unsolicited submissions received by mail or as a hard copy must be accompanied by a self-addressed, stamped envelop or they will not be returned. It is the submitter's warranty that any material submitted is in no way an infringement on the rights of others and may be reprinted without additional approval.

• All advertising subject to publisher's approval.

Note: Animal Tracks online and print publication will not publish graphic images or written descriptions of abused or dead animals or polluted and decimated environments; and will not knowingly promote or publish advertising or promotion materials for organizations that promote militant animal rights or illegal activities.

• All accounts must be paid in advance of posting to www.animal-tracks.com; or, for printed materials, prior to the specific edition camera-ready closing date, unless other credit terms have been approved. All ads canceled after the camera-ready closing date for the next upcoming printed publication will be billed at 100%.

• No Risk Guarantee. If for any reason the Animal Tracks newspaper or Archer New Media, Ltd. terminates print publication at any time, the advertising monies paid by you or your advertising agency for advertisements which have not yet appeared in the next planned Animal Tracks print publication will be applied to an equivalent online advertisement to run one year at no additional charge on Animal Tracks Online. If for any reason Animal Tracks Online or Archer New Media, Ltd. terminates online publication at any time, the advertising monies paid by you or your advertising agency for any advertisements which have not yet appeared in the print version of Animal Tracks, or online at Animal Tracks Online will be refunded within a reasonable time as to amounts not spent for online distribution or printing preparation.

• Animal Tracks Online holds you and/or your advertising agency jointly and severally liable for all charges due and payable to Animal Tracks Online and Archer New Media, Ltd.

• Frequency discount rates are allowed to advertisers who have signed a contract for multiple insertions. The contract year starts with the advertiser's first insertion. Multiple insertions cannot be made within any given month. The one-time rate will apply to all unfulfilled contracts. Advertising already posted online or printed will be charged to you and/or your advertising agency.

• Animal Tracks Online gives no guarantee of position unless you request one and Animal Tracks Online acknowledges that request in writing.

• All ads must be proofed and approved by you or your advertising agency before their insertion. You and/or your advertising agency assume full responsibility for the accuracy of your advertisement(s). If changes of any kind, including but not limited to errors in spelling or grammar, are not received and proof is not approved by the camera-ready advertising closing date for the issue the ad is to appear in, the ad will run AS IS. Any advertising material which does not fit the contracted space specifications will be altered to fit at advertiser's expense. Animal Tracks Online and Archer New Media, Ltd. are not responsible for advertising materials left in its possession. Materials which you and/or your advertiser would like returned should be accompanied by a stamped, self-addressed envelope.

• Animal Tracks Online and Archer New Media, Ltd.'s liability for any error caused by Animal Tracks Online and Archer New Media, Ltd., (including, but not limited to, omission, copy error or size error) is limited to crediting your and/or your advertising agency's account for an appropriate portion of the price of the advertisement containing the error. The portion will be determined at the sole discretion of Animal Tracks Online and Archer New Media, Ltd., according to the seriousness of the error. In no event will the credit be greater than the price of the first advertisement containing the error.

• You and/or your advertising agency assume all liability for all contents, statements and claims made in advertising submissions.

• You, and/or your advertising agency warrant and represent that you have the right to use any and all material contained in your advertisement, including but not limited to all copyrights and trademarks contained therein. You and/or your advertising agency will indemnify and hold Animal Tracks Online and Archer New Media, Ltd. harmless from and against any and all loss, expense, or any other liability, including but not limited to, reasonable attorney's fees resulting from any claims or suits that may arise out of the publication of such advertisements.

• We agree that in the event Animal Tracks Online and/or Archer New Media, Ltd. must bring an action to collect fees due under this Agreement, you shall pay for Animal Tracks Online's reasonable attorneys' fees and court costs, along with interest at the rate of eighteen percent per annum.

• This Agreement shall be governed by Ohio law without reference to or application of its Conflict of Law Rules. This is our entire Agreement as to all terms; all prior discussions, negotiations, and understandings are superseded by it. We agree that all lawsuits must be filed in Franklin County, Columbus, Ohio, and you consent to Jurisdiction therein.

• Unless agreed to separately in writing, all accounts due but not paid for over thirty (30) days shall bear interest at one and one-half percent (1 1/2%) per month on the outstanding balance.
